If you are suddenly in the position of not being able to pay your child support through
no fault of your own, you can do some things to avoid be hit with a contempt of court charge. You may have found yourself getting laid off or having to change jobs and your income is now lower. Whatever the cause, it lays you open to the Ex trying to get you for contempt. But there are things you can do to prevent that from happening. Here are a few of them:Make a payment of some kind, no matter how small. It shows willingness to pay which is proof you are not in contempt.
Make your payments at irregular times and for different amounts. This sounds strange, but it shows a struggle. If you pay the same smaller amount each month at the same time they think you are just trying to pay less.
Split up your payments if it helps make the payments.
Document everything including the dates and reasons you are now struggling in case you are ordered into court.
Contempt of Court is meant for those who are deliberately not paying, not those who cannot pay due to something they had no control over. You want to avoid a contempt of court charge if you can, and doing these things can help. Striving to do what the court has demanded is always a wise choice in a custody battle of any kind. You don't want to antagonize the situation any more than necessary.
