Proposition 19 - Regulate, Control and Tax Cannabis Act of 2010


The basics?

-California statewide ballot proposition

-Voted on November 2nd, 2010

-Focus on legalizing various recreational Cannabis activities

-Allowing local governments to tax and profit from Cannabis sales

The law changes for individuals

-May possess up to 1 oz of marijuana on your person

-May use marijuana in private residences OR licensed public establishments (not for public use)

-May grow marijuana in a space less than 25 sq ft for personal use only

The law changes for local governments

-May authorize the sale of up to 1 oz per sale and regulate business hours and activities

-May authorize larger sales for commercial purposes and cultivation

-Allows the transportation of marijuana for commercial sales and distribution

**Most of these new regulations are very similar to alcohol**

Tax changes

-Allows local governments to impose new taxes on the sales and distribution of cannabis

Criminal Law changes

-Maintains existing laws regarding sales to minors AND driving under the influence

-Maintains an employer's right to address consumption of marijuana on the jobsite

-Maintain existing laws against interstate OR international transportation of marijuana

-Every person 18 years of age or older who hires, employs, or uses a minor in transporting, carrying, selling, gifting, or selling marijuana shall be imprisoned for a period of three, five, or seven years

-Every person 21 years or age or over who sells or gifts marijuana shall be imprisoned for up to 6 months and fined up to $1000

-Any individual who is licensed, permitted, or authorized to sell marijuana, who knowingly sells or gifts marijuana to someone under the age of 21 will be banned from owning, operating or being employed by a licensed marijuana establishment for a year

Outlook on the future IF marijuana is legalized

California's fiscal impact will be very large, estimates are around $1.4 billion dollars of increased revenue for the state. Besides tax revenues, the state will save millions in funds annually used to maintain marijuana offenders, whether it is incarceration, probation or parole. These are benefits that will greatly help relieve California of it's large fiscal debt and bring us out of a difficult recession.

Although it may generate billions of dollars for California, many people are worried about the repurcussions of legalizing an illegal drug for the public.

- Will a black market be created between a legal marijuana state and all the illegal bordering states?

- How will marijuana affect drivers throughout the state? Will there be a large increase in "stoned drivers" ?

- Is it going to be very accessible for our minors that are already being influence by alcohol at early ages?

- Does this create a stigma for California as a political powerhouse in the U.S.?

- Will the federal government react and create larger issues for California?

There are a lot of unknowns and questions to be asked if the future of California is one with legal marijuana. But one thing is for sure, it is being put to vote for the people AND by the people, thats as democratic as it comes. Be intelligent, read up on your local and state laws and make informed decisions this November 2nd.
