Indian legal system is a compilation of laws drawing its origin from various sources
beginning with the customs of the ancient Vedas embodied in the present day Hindu personal laws governing primarily the area of marriage, succession, adoption and guardianship. Questions of law and facts involving the application of provisions of law derived from the various sources of law are adjudicated upon by the three tier hierarchy of courts followed in the country namely by the civil courts, criminal courts, family courts and various district courts which form the first level in this hierarchy followed by the High Courts of various States and finally by the Supreme Court of India which comfortably rests at the top of this hierarchy.
High Courts are at the top of hierarchy in each state and enjoy both original jurisdiction as well as appellate jurisdiction over the district courts of the States. However, most work of High Courts includes appeals from lower courts, writ petition under article 226 of the Constitution of India and supervisory jurisdiction under article 227. Thus High Court is the highest court of appeal in matters of civil and criminal cases of the State.
In contrast the Supreme Court of India is the highest court of appeal in the country. The appellate jurisdiction of the Supreme Court can be raised by certificate granted by the High Court under article 132(1), 133(1) and article 134 of the constitution in matter of any judgment or final order of the High Court in both criminal and civil cases.
