In the 18 minute delay before the expecting mother was taken to the hospital the baby was deprived of an appropriate supply of oxygen due to her loss of blood from the placental abruption.. The newborn survived for merely one day after birth. The mother's blood loss was so extreme that she had to undergo further surgery to control the bleeding and later temporarily lost kidney function. The law firm that handled the legal claim named the paramedics in the lawsuit.

Every State has its own specific laws for medical malpractice and wrongful death cases. The mother was successful. The law firm that represented her reported that after taking the case to trial the jury returned a verdict in her favor and awarded her $4,500,000. Paramedics are health care providers. They are trained and they are licensed. They are supposed to be able to identify signs of emergency health issues and to take proper and timely action. If they do not and their actions fall short of the applicable standard of care, they may be liable.
