The Lawyer Who Serves Indigent Clients
An attorney claimed that it was unconstitutional that lawyers are not properly compensated
when they represent indigent clients and demanded that this system be abolished in place of a fairer one. The lawyer brought to the attention of the court that requiring attorneys to pay for the poor citizens' legal services was unfair treatment. The reactions and queries of the justices in the court showed that he definitely got their attention and sympathy.
The compensation problem is pervasive especially in rural areas since there are hardly any lawyers and there is not a single public defender's office. Judges end up having to create a defense system for the indigent and also to give lawyers cases on a rotating basis. The legal profession is not responsible for giving indigent criminals a fair trial and defense because these are the responsibilities of the state.
Does the constitution contain the rights that lawyers must have? Of all the groups of people that exist in the United States, only lawyers are being required to give up much of their time and wealth for the poor in return for insufficient compensation. Other professionals and laborers should not be excluded from this requirement given solely to lawyers.
Whether or not the compensation will satisfy the attorneys, they have a moral and ethical duty to represent a client. Payment to attorneys for public defender work is not a constitutional duty of the state. In the state of Kansas, attorneys are obligated to represent anyone in the public.
Lawyers are definitely not making money when they represent indigent clients. While my heart goes out to attorneys faced with the problem of compensation, it is still the duty of attorneys to defend indigent clients. Attorneys have no constitutional right to earn a profit representing indigent clients.
An attorney says that while he understands his duty to the poor, he is not willing to let it be the cause for any grave financial situation he would find himself in. A justice explained that she couldn't understand why during a financial crisis, private attorneys' rates were cut down while the public defenders' offices' budgets remained as they were.
The justice saw the similarity between the present condition of the state and the old federal system where the attorneys provided legal services without any form of compensation. There now is a federal public defenders' system.
Attorneys are not only given unfair treatment of having to spend to defend their indigent clients, but their clients are denied their constitutional rights to proper and sufficient legal representation. You end up weighing your own financial situation on one side and your client's constitutional rights on the other. The defendants are denied their constitutional right to a fair trial.
Representing someone used to be an honor. Juvenile and probationary cases were then included in the package. The system is headed for doom. I am willing and proud to work for free once in a while. This thing became uncontrollable.
