Philadelphia Accident Attorney Reviews Top Ten Mistakes That Can Wreck Your Accident Case

Car accidents can leave the most levelheaded people shaken up

. However, no matter how emotional you are it's best not to say too much at the accident scene. After an accident, there are things you can and should do.First of all, at the scene, try to find a safe place away from any traffic to wait for emergency personnel, police, and to exchange information with the other driver. The following mistakes to avoid are listed below:

1)Not calling the police. It is very important to call the police and to wait for them at the accident scene or talk to them as soon as possible following the accident.

2)Not getting information from the other driver. Make sure to get the name, address, and phone number of the other driver as well as the license plate/tag number for the other driver's vehicle and the state that the license plate is registered. If there are any witnesses to the accident, get their names, phone numbers and addresses as well.

3)Not notifying your insurance company. You should report the accident to your insurance company as soon as you reasonably can after the accident.Typically an insurance policy simply provides that you give them notice of the accident as soon as possible after the accident. The insurance company does not necessarily have your best interest in mind. They have their own best interest in mind.It is always a good idea to contact an attorney following a car accident.

4)Believing that the insurance company calls you for a recorded statement, you must give them a statement or they wont settle/believing that you must sign forms that the insurance company wants you to sign. If an insurance adjuster calls you after an accident, should you talk to him? You can, but we dont recommend it.The adjuster usually will want to take a recorded statement about the accident and your injuries. This benefits the insurance company, not you. Also, some insurance companies will try to pressure you into settling your case early in the claim process. Dont fall for that trap.

5)Failing to know what all of your damages and injuries are, and failing to document them. Seek medical care as soon as possible. Tell your doctor what all you injuries are, but do not exaggerate.Keep records of all of your medical bills, and of the expenses you spent going back and forth to the doctors.Keep your receipts for co-pays and deductibles.Dont forget that you are entitled to be reimbursed for any wages that you lose as a result of the accident.

6)Waiting too long to seek medical treatment.Initially after an accident, you may not think you are injured. Some injuries may not cause you pain until days after the accident. It is extremely important to seek medical attention as soon as you realize you are hurt. Waiting to see if your pain goes away is a sure way to wrecking your injury claim.

7)Hiding past accidents or injuries from your lawyer or doctor. The insurance companies have access to extensive databases that enable them to find out personal information such as how many accidents you have been in and how many times you have made an injury claim. They will try to use the information against you.Not giving accurate information to your doctor or lawyer, or trying to hide information from them can destroy your case.Remember your lawyer must have complete and accurate information on your medical history and prior accidents in order to fully protect you.

8)Stopping your medical treatment before you are released from your doctor. You should follow the full course of treatment prescribed by your doctor.Injuries take time to heal and your doctor will know when you have fully recovered or when there is nothing further he or she can do for you.If you stop going to the doctor before he or she releases you, your medical records will reflect that you discontinued treatment.

9)Misinterpreting your activity level.Insurance companies routinely hire private investigators to conduct videotape surveillance. This was true 20 years ago and it is still true now. Lying about or exaggerating your injury is a sure way to wreck your injury case. Be honest about your activity level and when describing to people what you can and cannot do.Facebook is just a new form of videotape.

10)Not asking questions of your doctor. Question Your Doctor In Personal Injury Cases about his experience dealing with the types of injuries you have suffered, his treatment plan, his prescription or nonprescription medication suggestions, the tests he will perform, his willingness to prepare a report or testify at your trial, the permanence of your injury, the frequency of follow-up visits, and whether he plans to refer you to other specialists for your injuries. In this way, both you and your doctor will be prepared if your case goes to trial.
