How To Stop Debt Collector Calls
There is nothing worse than phone calls from pesky debt collectors andjust because
you are not in debt does'nt mean you won't receive calls from debt collectors. In any case, most people do not want to recieve these calls.So how can you stop debt collector calls?
The first thing to know is that you have a legal right under the Fair Debt Collection Practices Act (FDCPA) to stop debt collector calls. The debt collector can call not only you but also your workplace, your neighbors and friends in an attempt to get information about your whereabouts and can call over and over again if he or she is under the belief that your friends, family etc have new information about you and your residence.
You must therefore stop the debt collector calling your family, neighbors, friends and work. It is not difficult but you must be quite firm and specific about what you want. However, if it is a computerleaving messgages to call you will need to call back the debt collection agency for further information.
First without acknowledging the debt or entering into any kind of argument or discussion, simply ask the name of the caller, company name, address, phone and fax of the company the person calling from, and the name of the credit company which they are acting for. Don't let them change the topic because they have to give this information.
Secondly, tell the agency that by law (the FDCPA) all calls to yourself, family, friends, neighbors, work and any other phone numbers they have on their system, must immediately cease, and, any further communication with you must be in writing . If they ask you to verify your contact details tell them to forget it because they already have it.
Third, inform the caller that any further calls from them will be considered harassment and you will record the phone calls and report the agency. If you intend to record phone calls you must inform the person before recording and only use tapes or cassettes.
Fourth, although not essential, it is a good idea to put your demand in writing addressed to the debt collection company and tell them this is what you will be doing.Whenever you write to the company always use registered and certified mail, the type that give you a notice that somebody has taken delivery of the letter.
Above all remain calm and do not argue. If you get upset or angry it will detract from what needs to be done which is to get contact details from the agency and tell them to stop calling.
Remember that by stopping one debt collector from calling does not prevent others from calling and you will need to inform each and every one as it happens.
