A Good Lawyer Can Minimize the Strain of Divorce Proceedings

When it comes to a divorce case, we try to get the results that are the most reasonable. We always encourage parties to reach reasonable compromises that are in their best interests. If that is not possible, then of course we are always ready to go to court or to litigate the areas of dispute with the client to achieve results that are in their best interests.
A lot of people feel a real sense of loss during divorce proceedings, and it can also be a very difficult time financially. We try to protect clients in that regard, and to minimize the financial effects of their divorces. We always hope and strive to do what is in the best interest of each client.
We deal with all of the issues that are involved in divorce, such as:
Child custody. In many cases, it goes without saying that custody issues are often the most highly-charged. The Court will determine the legal custody and residential arrangements for the child in accordance with the best interest of the child. In determining that interest of the child, the Court considers all relevant factors, including eight statutory factors. These include: the wishes of the child's parents; the wishes of the child and the relationship of the child with the parents; any other residences of the parent's household; the child's adjustment to home, school and community; the mental and physical health of all individuals involved; the past and present compliance by both parents with their rights and responsibilities to the child; evidence of domestic violence; and the criminal history of both parties. The Court does not presume that a parent, because of his or her sex, is better qualified than the other parent to act as custodian to the child.
Child support. Parents have an obligation to financially support their children, and in a situation where the parents are no longer together, the Court can order a non-residential parent to pay the residential parent money for the support of the children. There is a calculation that is used by the Court to determine the amount of child support, which takes into consideration both parents' income and the needs of the child.
Division of marital property. The Court, upon request, will divide and distribute the marital property in a way that is seen as fair. And it considers many factors in determining what is fair, such as the contribution of each party to the acquisition of the assets, the financial circumstances of the parties, and the contributions of the parties as homemaker or spouse.
Alimony. Alimony can be awarded by the Court to a dependent spouse. A dependent spouse is someone who does not have enough income or other resources to meet his or her reasonable expenses. The Court can award alimony in an amount and for such time as it deems fair. For marriages of less than 20 years in duration, the Court can award alimony for up to one half the length of the marriage. For marriages of 20 years or more, the award can be permanent.
Payment of court costs and attorney's fees. One party will be ordered by the Court to pay the other party's court costs, including filing fees and attorney's fees.
