Understanding The American Constitution
Most everyone has heard of the constitution and knows what its purpose is in the United States of America
. It has many different rules and laws that every American citizen should be aware of and familiar with.Basically it is a set of laws that a certain group of people who lived here in the very beginning of this nation's history made and agreed upon. These rules help to govern this nation and keep some sort of order so that people may live in peace.
These rules also help tell people how to go about solving problems that this nation will and does encounter. It tells every branch of government what kind of power they are allowed to have and how they must function within their political entity.
It is a system of law that defines the United States of America and how the government should function. The big three branches include the judicial, executive, and legislative.
The judicial branch (which is also known at the judiciary or judicature) is the one who has the power to interpret the already existing laws and how they should be applied within each state. They are the tool that helps solves disputes between two parties.
Because they are the ones who interpret the law, they cannot be the same ones who make the law. This falls under the separation of powers in the United States government and has been thoroughly explained within the Constitution.
The legislative branch is made up of the people who make the law. They have the power to pass a new law into existence or to veto it or to amend it.
This may seem like a lot of power but before a bill becomes a law, it must go through several different stages and be voted upon by many different people. There is not just one person who can decide whether or not a bill should pass.
Other names for the legislative branch are parliament and congress. The United States government uses a bicameral legislature in which there are two houses.
The first house in known as the Senate which has one hundred members and each member serves for a term lasting six years. Each state has two senators even though their population sizes are not all equal to each other.
Every two years, there are about one third of the senators who are up for election. The current vice president serves as the president of the senate.
The second house in congress is known as the House of Representatives. There are four hundred and thirty-five members that make up this group and they each serve a term lasting for two years.
They are also elected by the people just as the senators are. They represent a certain district from their state and this is where the state's population comes into play.
Obviously the more people that live in a state, the more power they should hold. This country works on a majority voting system in order to fairly represent the people.
This document was created on September 17, 1787 and ratified on June 21, 1788. The original document is located in the National Archives in Washington, D.C.
Delegates from the Philadelphia Convention were the authors and thirty-nine out of the fifty-five delegates signed it. It was a national constitution to replace the Articles of Confederation.
Since then, this document has been amended only twenty-seven times. The first ten changes known as the Bill of Rights were put in right away.
One of the articles in this document amends the power regarding slavery and taxation of the people. The sixteenth amendment also authorizes federal taxes on income.
They figured out that depending on how many people live in a certain state, that state should owe so many taxes to the federal government since they have the most representation. The Constitution is made up of the preamble, the articles, the Bill of Rights, and the rest of the amendments.
This document serves a very important purpose in the United States and is referred to all the time. It is the framework for the United States of America and its organization which helps people to define the relationship between all the different branches or government.
