The latter may take the contractor to court to recover their money -- which once proves why the 'surety bond' is not exactly an insurance policy. The contractor would have to pay the money reimbursed. Ensure that you get the best contractor out there, even if he charges a little higher than the market rate for it is worth the trouble.
