Why Family Court Is A Kangaroo Court With Predictable But Unconstitutional Outcomes

The Family Court is a kangaroo court because of its predictable and unconstitutional

outcome - an outcome that deprives a father of his children, and most all his fundamental rights. It's maintained so by the power, money, and agenda of the state-based divorce and domestic violence industry. And here are the perverted and unconstitutional characteristics that allow this to be so.

The family court is characterized by

* judges' virtual unaccountability

* due process violations

* vague laws and meaningless standards prevail having no determining elements for a clear outcome to be predicted

* The combination of court and state usurpation of children and the court's dangling them as carrots for fit litigants to fight over - and for lawyers and other court-affiliated parasites in this unconstitutional setup to profit from, and lastly.

* a predetermine outcome and why it is this way

-Judges' virtual unaccountability :

Judges play both judge and jury in the 'bench' trial you get in family court. So, the judge alone is the complete arbiter of what will happen to you.

Today, judges have no real accountability for their actions and judgments. You can appeal against their judgment or do a judicial conduct complaint on their court behavior at most. But winning an appeal is rare and punishment of judges is virtually nonexistent by the Judicial Conduct Commissions. It's all a closed shop for the legal elites - and the people are kept out of any loop that would enforce accountability.

As a result judges maintain out-of-control and unconstitutional discretion in their judgments which allows them free rein to tyrannize litigants - overwhelmingly fathers. The chance of their impeachment under existing procedures is truly a snowball's chance in hell.

This virtual nonaccountability of judges is WRONG; but of course it's never exposed as such by 'the legal elites in charge'.

-Due process violations:

There's no jury for protection of litigants. And judges do not follow any of the required constitutional due process when fundamental rights are at stake. But family court deals almost exclusively with denying fundamental rights of its litigants.

Women are not held accountable for perjury as shown time and again. Lawyers are not accountable for obvious coaching and misrepresentation of what they say in support of women or mothers as shown time and again.

Finally, your own lawyer is afraid to stand up against to the injustice for fear of losing his ticket to practice by the Board of Bar Overseers to whom judges complain about lawyers who try to hold judges or other lawyers accountable for their actions - or are considered just too aggressive at defending their 'father' clients.

-Family court's vague laws have no real determining elements:

Family courts' vague laws based on no real determinative elements prevent predictable and just outcomes. So nothing restricts an overriding discretion of the judge. He or she can force virtually any outcome.

No law governs who of two fit parents gets physical and/or legal custody of children (implying who of the parents will be denied their parenting right) - only a meaningless standard called 'best interest of child' prevails. Of course, constitutionally, neither fit parent should be denied his or her rights!

The law on restraining order abuse is subjective and the judges continually rule only on a statement of fear by the mother with no proof of truthfulness in her claim. Any 'objectivity' alluded to by the law is simply a joke.

Maxims of laws are ignored. Mothers who have abused their husbands, break the marriage contract willingly, and deny their children parenting by their father are rewarded by family courts.

-Meaningless standards: best interst of the child and safety of women:

For these there are quasi elements that the court ascribes to, but they are not determinative, nor, often, are they even applied. It's a joke

One of two fit and perfect parents - with NO WRONG DONE - will lose custody and a host of other fundamental rights (overwhelmingly it will be the father) if the other parent or both do not want to share custody. And, of course, mothers overwhelmingly (and abusively to the fathers and to his children) DENY fathers' shared physical custody since mothers' malicious greed will be rewarded by the family court, if they don't.

Safety of Women - in abuse issues- has no standard. Normal assault and battery laws and procedures are ignored. Judges just rule in favor of women with no regard to the clear unconstitutional deprivation of a man's rights and his right to due process.

-Court seizes and then dangles children as its prize for the winning litigant:

States and their family courts under a complaint for divorce, unilaterally seizes control of the children. This is unconstitutional since either party is not ever proved unfit. The use of unfitness or other constitutional compelling reason (life-threatening harm by a parent) is never a criterium to deprive a parent of his child - as constitutionally it should be!

So having seized all authority over the children, the family court then sets both parents fighting each other to win - not their children back - but simply the state's entrustment of the children to one parent only.

-The kangaroo court outcome - and why:

So the bottom line is that if the mother does not want to share physical custody with the fit father, then she will effectively be rewarded physical custody and large child extortion payments - euphemistically called 'child support'- from the father. This is an enormous incentive for mother NOT TO AGREE.

The setup produces the predetermined outcome that the mother will get physical custody unless she's clearly unfit. This overwhelming presumption not only perverts what meager due process there is in family court, but is evidence of the power of the feminist-instigated divorce and domestic violence industry that maintains this system and its tyranny against fathers in spite of enormous constitutional deprivations of fathers. This industry wags the court as its tail.
