A child power of attorney can be used for a variety of situations, where the parent cannot take care of their child or children for a number of reasons. These reasons can include, but are not limited to:
The parent is out of the country on business.
The parent is active military and will be on an extended leave or has been moved.
Hospitalization due to physical or mental illness.
Loss of the primary residence due to a natural disaster or some other form of disaster.
Incarceration for one reason or another.
Of course these are not the only reasons that a person may need to appoint an adult friend or relative the authority to care for their child or children with a child power of attorney. However, whatever the reason may be, the appointment is temporary and given to another person to take care of the child or children until the situation is resolved. The appointment can last 6 months and sometimes longer when necessary, however the parents can revoke the child power of attorney at any time and without any reason given. If the appointment needs to be longer, then a new form needs to be completed usually every 6 months. Also, the parents are not giving up their parental rights either. They are still the legal parents of the child, they do not give up their rights at all. When an adult relative or friend is appointed the agent in a child power of attorney there are different responsibilities that the agent will take on. The appointment will allow the person to make all decisions pertaining to the child or children. These include medical care, schooling and any and all other day to day activities that need to be decided for the child or children. There are a few decisions that the appointed person can not make, under any circumstances. These are:
A child power of attorney does not give the appointed person the authority to authorize the adoption of the child or children by another person while the power of attorney is in effect.
The appointed person does not have the authority to consent to the minor child or children getting married without the child or children receiving the legal parents or guardian's consent.
Property that a child or children own can not be given away or sold by the appointed person without the legal parents or guardian's consent.
A child power of attorney can be put into effect simply by filling out the form and having the parents or guardian's signature notarized by a notary public. The person that will be caring for the child or children will need the signed and notarized document in case they need to show proof that they have been given the authority to care for the child or children by the parents or guardian. Lastly, when a parent or guardian wants to appoint an adult relative or friend to care for their child or children using a child power of attorney, the form does not need to be filed with the courts.
