UMC Hospital in Las Vegas Clearly Doesn't Understand EMTALA Rules

Share:We currently have another wrongful death lawsuit, however this one involves 2 hospitals that displayed the same negligence. The suit is against UMC Hospital in Las Vegas, as well as Valley Hospital in Las Vegas. The suit alleges the plaintiff, Roshunda Abney came in to the hospital with severe stomach pains and essentially, the hospital said they were to busy to help here. Both hospitals turned her away saying they were to busy to help her. There are many scenarios that could definitely come up in trial. Many many he said, she said situations. However, the major isssue is EMTALA Rules. Basically these are the rules that determine how every hospital must conduct business, especially when someone is in pain. In a brief conclusion of the rules states that the hospital may not create a hostile environment in which causing a patient in pain to leave the hospital. Basically, all people with pain must be looked at first if in your hospital, and you have to be nice. A major issue here is, the nurse was clearly rude to the plaintiff, and rude to the other patients according to witnesses. However, the major issue is that Roshunda Abney was pregnant, and subsequently delivered the baby on her own and the baby died. Valley hospital is also in the suit claiming their nurses were rude and making unprofessional remarks, which seems to be heightened because they had the chance to correct the wrongduing of UMC hospital, but instead decided to make it worse. The moral of the story here is Healthcare in America is in serious peril. The true feeling and understanding of the atmosphere during both exchanges at each hospital will never be known. But it leads to an interesting feeling of helplessness when a person is hurt. The hospital should be the safest, most reassuring place to be when you are hurt. Instead it has turned into a tense fight for control. Hospitals proving they are in control, in which they clearly are, and the patient in a panic for their safety and sometimes life. If only these healthcare places could remember what they are in the business for. They way I understand it, healthcare is designed "Protect and promote the health of patients and the public."
