The Motor Insurance Bureau

If you have been unfortunate enough to suffer whiplash because of an untraced or uninsured driver

, you will still be able to make a claim. But as there is no defendant insurance company to handle the case, your claim must instead be taken through the Motor Insurance Bureau (MIB). In this article we explore the MIB in more detail, explaining why it was set up and what it can do to help innocent victims of whiplash.

What is the Motor Insurance Bureau?

The MIB was set up in 1946 to ensure those injured by uninsured or untraced drivers were still able to claim compensation for the damage they wrongfully endured. It is an industry led organisation funded by all UK motor insurers.

Motor insurers in the UK are only allowed to operate if they are a member of the MIB and contribute towards its costs. To cover this expense, insurers add an average of 40 to each individual insurance policy, although this sum tends to increase every year as the number of uninsured drivers continues to rise. It is, therefore, up to law abiding motorists to cover the cost of irresponsible drivers.

The MIB operates under two separate legal agreements. The first is the Uninsured Drivers Agreement which allows those harmed by an uninsured driver to claim compensation. The second is the Untraced Drivers Agreement which guarantees those injured during 'hit and run' accidents can claim for the damage they have sustained.

Making a claim with the Motor Insurance Bureau

The MIB is considered to be an insurer of the last resort. This means that an alternative route should be found if possible. For example, you should ask a lawyer to attempt to trace a negligent driver by running a search through the Motor Insurance Database. However, if no other option is available and you have suffered whiplash through no fault of your own, you should take your case to the MIB.

If you would like to make a claim under the Uninsured Drivers Agreement or the Untraced Drivers Agreement, you need to contact a legal expert who is able to deal the MIB claims. This is because the process differs to the ordinary procedure, so you need a solicitor who has the necessary skill and professional knowledge to act on your behalf. There are many whiplash specialists on the market so ask the right questions and choose your solicitor carefully.
