Advertisements will leap out at you whether you are driving past a billboard, looking in the phone book or newspaper, or even when you are watching your television. They all say that they can help in the event of a car accident. You will see victims on stretchers under blood red headlines in the phone book, and free offers of services until your claim gets settled. There are even those who are offering a loan to you that you can pay back when you receive the settlement.

An insurance bureau is claiming that such advertising, made by personal injury lawyers, is driving up claim cost. This is result in some motorists not even getting coverage due to the increases. The bureau's regional services manager has cited several instances where, even though the vehicles were barely damaged, people asked for and were awarded huge settlements for their injuries. She goes on to say that there isn't a problem with compensating victims who are truly hurt, but the amount of money expected is growing.

The claim amounts are causing auto insurance premiums to be raised, but the amount is different with each company. The typical rise in cost for drivers at an average risk level ranges from 15 to 35 percent. If you have a ticket or accident on your record, you'll be charged a much higher increase.

Lawyers say there's no link between their advertising and the increase in claim costs. What the insurance bureau is trying to do to help is asking for limited double dipping by victims. Cases have been seen when claimants want to be compensated for lost work time, but their own companies have already compensated for this. The amount awarded is usually in gross wages, before taxes and other deductions are made. This become a dissuading factor for the employees to return to work. A longer absence from work means a higher pay off.

Attorneys suggest that they are unaware as to the exact size of the plaintiff's tort bar, though they are pretty certain that there are not many more venues in which they could find new opportunities. While most let claimants seek payment for pain and suffering, some require that the injury sustained be permanent and serious for such a payment. The insurance bureau wants you to think that the aggressive advertisements by lawyers is what is bringing so many lawsuits in, but that isn't true. Lawyers should be allowed to work for free for claimants until the case is settled; they should also be allowed to offer to pay for any disbursements if the case is lost.
