How To File A Personal Injury Claim

How To File A Personal Injury Claim

Most claimants are aware that personal injury claim is a term given to various types

of claims such as road accident claims, work related injury claims and trip or slips in public areas but many claimants are not aware that the process of filing each of these claims is different from one another. This article will help you understand the things you need to do while filing the types of personal injury claims mentioned above.

Before filing a personal injury claim the claimant should understand that if he hits an animal on the road then this will be counted as a personal injury case but if an animal attacks him on someone elses property then this will be considered as a criminal assault case.

To file a road accident claim the claimant must begin by calling the police or local law enforcement officials when the accident occurs. The police or law officials will file a police report that describes the accident and the law officials will give the claimant a copy of the report so that he can file for compensation.

To file a work related injury claim the claimant has to report the accident to his superior as soon as possible so that the superior can file an official report in the companys accident report book. This official book acts as a proof that an accident occurred and it also allows the employer to review the safety rules in his office to prevent further accidents. How To File A Personal Injury Claim

To file a trip or slip personal injury claim the claimant has to contact a solicitor and give him the details of the accident. The solicitor will get in touch with the people who were at fault and he will work out a suitable compensation.

If the claimant wants 100 percent compensation then he has to do two things despite the type of

personal injury claim
he is filing. The claimant has to first seek medical help for his injuries even if they are minor so that he has proof that he suffered a personal injury due to the accident. While seeking medical help the claimant has to mention the circumstances in which the injury occurred so that the doctor can enter this information into the claimants medical records. The claimant also has to collect bills, receipts and discharge papers that suggest that the claimant spent a certain amount due to the accident. The claimant then has to appoint a legal adviser or a personal injury solicitor to help him file the claim. A personal injury solicitor will not only provide legal advice but he will also represent the claimant in court and ensure that the claimant gets maximum compensation for the case at hand.
