"I've known these guys for 20 years, they wouldn't sue me." If I have heard that once, I've heard it a thousand times. The truth be known, that is a very nave statement. Generally, it is not the hunters that you have to worry about. What if the hunter by some freak of nature accidentally shoots the neighbor's son? The neighbor is going to come after whomever he feels has money and can be tied to the liability of the incident. You may know and trust your hunters but if one of them is a husband providing for his family and has a fatal accident on your property, do you think his wife cares how she gets the money to support her family? You cannot predict how someone is going to act when backed into a corner. A Hunting Club Insurance policy is the best way to protect you from unforeseen liabilities when accepting money for hunting rights.
Most states have passed laws that indemnify those that just give permission to hunt on their land. I know some folks that take cash so that they don't have anything in writing thus thinking they are protected by state statute. Come on. Do you really want to commit perjury when the plaintiff's attorney asks you under oath if you accepted money for the right to hunt on your land? Wouldn't it be a whole lot less stressful to let the insurance companies' attorney deal with it and defend you? This is one of the biggest benefits of buying liability insurance. The insurance company is obligated to defend you or make a settlement on your behalf. Think of the thousands of dollars you could spend just defending yourself against a frivolous claim if you are not insured.
Then there are those that say they don't need Hunting Club Insurance because they made the lessees sign an indemnification clause as part of the lease. I do recommend this to be part of the hunting lease agreement but truthfully the release of liability clause is not worth the paper on which it is written. The same rules above apply. The person that signed the lease is probably not who you should be worried about. Do yourself a favor and spend the few dollars for a hunting lease liability policy and sleep well at night.
