Child Custody Information: Know The Basics

Getting into the battle for child custody bring quite traumatic experiences to both the partners

. There are many things that are really essential for the parents to know. Such child custody information is generally defined by the child custody agreement that becomes the basis of many things. In general courts approve such agreements that include necessary elements like Physical custody, Legal custody, visitation schedule, child support, major expenses etc.

It is important to understand the difference between legal custody and physical custody. Legal Custody is the parents' right to make legal decisions for the children, these would include medical, religious or even educational decisions. Parents are generally given joint custody unless its proved that one parent is unfit. Physical custody is where and with whom the child will stay and his/her day to day care. Physical custody is generally given to the parent with whom the child has stayed at least 60% of the time.

There must also be a visitation schedule. This schedule will specify the visiting partners schedule for visitation on a weekly basis. This schedule must also include school vacations and holidays. You must also mention how you will handle making changes to the visitation schedule if need be. Visitation schedule will be necessary only when one partner is the primary custody. Otherwise, the joint physical custody arrangement would require for a schedule only over Holidays.

The disciplinary rules must be specified in the child custody agreement. This will make it easier to decide how each parent will be involved in making major decisions for the child and his / her upbringing. The legal custody agreement must mention all points of agreement so that everything is in written and documented for future reference.

Along with this the parents must also decide on how the costs for the major decisions will be split. For example how are they going to pay for the child's education or how are they planning the medical expenses etc. All these are parts of child custody information.

Child custody agreement must have provisions for child support. The parent that has the primary physical custody must pay for child support. In most jurisdictions child support amount is very statutory, and can be different only on some points. The amount depends on the supporting parent's gross salary and the number of children in question. However, you can check with an attorney in your jurisdiction regarding the appropriate law. This is a must in any child custody agreement or the agreement may be rejected. A judge reviewing and approving the child custody agreement will certainly let you know if there's anything that you may have missed out in the agreement.

In case you are having your battle in Illinois, an Illinois child custody attorney will provide all kinds of child custody help.
