$6.15 Million Settlement Attained In Lawsuit Regarding Disabled Child

When a newborn with a GBS infection does not immediately receive antibiotics the results can be disastrous

. A Group B Strep infection in a newborn can develop into pneumonia, sepsis, or meningitis. Given a newborn's undeveloped immune system this can produce such long term disabilities as cerebral palsy, seizure disorders, brain damage, cognitive and motor retardation. It can even lead to the passing away of the baby. In the remainder of this article, we analyze a lawsuit that came about after a newborn who exhibited signs of a Group B Strep infection was not diagnosed in a timely fashion by the doctor.

Consider a reported lawsuit where antibiotics were intravenously given to a pregnant woman while she was in labor. This is standard protocol for women who were carriers during the pregnancy, a previous pregnancy, or when tested in the course of weeks 35 through 37 of the current pregnancy. The mother's infant appeared healthy at birth. In this case, 6 weeks after birth the baby started showing signs of infection. The mother took the child to a pediatrician who found that the child had a high temperature. The physician, unfortunately, did not look at the prenatal records even though she had access to them.

Unaware of this history, the physician ordered testing to diagnose the reason for the baby's symptoms. By not giving antibiotics to the infant right away antibiotics the physician allowed vital time to go by during which the newborn became septic, developed meningitis and experienced strokes. This left the newborn with mental retardation and an untreatable seizure disorder .

The law firm that helped the mother and her baby was able to get an admission from the pediatrician that she would have given antibiotics immediately if she had known that the infant had earlier exposure to the bacteria. The case was reported as settled by the law firm for the amount of $6,150,000.

There is an important lesson that this lawsuit brings out. If a baby exhibits signs that are consistent with a GBS infection a physician should take fast action so as to avoid the infection from turning into sepsis, pneumonia or meningitis. If not, the consequences might be disastrous. If the physician does not consider a GBS infection in the differential diagnosis thereby delaying treatment with resulting tragic effects the physician might be liable under a malpractice lawsuit to be entitled to compensation for the injuries endured by the child to protect the baby's future.
