Other than the breaching of contract, it is the duty of the sales person not to mislead the customer; this is his fiduciary duty. If this fiduciary duty is found to be miss-done then another case of action would be done whereby the customer might be compensated for the damages that would have been caused by the misrepresentation. These damage could include: out-of-pocket paid premiums, if there was accident which was not covered in the policy due to DUI conviction so the cost of repairs and other damages would be included in the compensation.
