Bus firm disputes compensation sum over crash injuries

A bus company that has admitted liability for motoring offences that resulted in

a man being injured is disputing how much compensation should be issued to the victim.

In August 2007, prison guard Jason Martindale was involved in a collision with a bus that saw him sustain a severely injured left arm, fractured right leg, head injury and psychological damage, Lutterworth Today reports.

The 38-year-old was riding his motorcycle at the time of the accident and accused the bus driver of traffic offences.

After the crash, he was rushed to Milton Keynes Hospital, which treated a total of 68,746 accident and emergency patients in 2006-07.

Subsequently, Mr Martindale was transferred to Royal National Orthopaedic Hospital in Stanmore for surgery on the nerves of his left arm.

While he has managed to regain some use of the limb, he still needs to wear a splint and takes medication to control the pain.

Rather than returning to his old job, he works in the prison's control room, which he claims is less rewarding and has stunted his promotional prospects.

While Arriva the Shires admitted traffic offences had occurred and accepted liability, the two sides cannot agree on how much should be paid in damages.

Mr Martindale says the bus driver was negligent and failed to keep a proper lookout. He therefore changed lanes when it was unsafe to do so, he suggests.

He is seeking damages, as well as an order allowing him to return to court to seek further payments if his condition deteriorates.

A writ has been issued by the lawyers working on his behalf and the case remains ongoing.

There is a time limit imposed on legal claims made as a result of alleged motoring offences and, in most cases, they must be filed within three years of the date of the accident.
