$4,500,000 Settlement In Malpractice Claim Concerning Delay In Childbirth After Placental Abruption
It is common for pregnant women to place themselves and their unborn baby in the care of a doctor who will see them through labor and delivery
. It can oftentimes take a fair amount of time following the patient's admission to the hospital before the newborn is delivered. During somepart of this time doctors at times depend on the nurses and staff to check the expectant mother's progress and to keep them up to date of any issues that might arise.The physician remains accountable for supervising the nurses and staff. Additionally, the nurses and staff are responsible for having the knowledge, training and experience to recognise symptoms of problems and for telling the physician when they do come up. Unfortunately, nurses and staff in some cases fail to meet these standards.
Consider the reported claim regarding a pregnant woman having reached full term commenced having contractions while at home. On the way the local hospital the woman also commenced experiencing unrelenting intense pain. Upon reaching the hospital the woman informed the admitting nurse that she was in severe pain alerting the nurse that she believed she had a complation to the pregnancy. The expectant mother was transferred to the Labor and Delivery unit but the nurse either did not understand or dismissed the womans complaints and did not get in touch with the physician, who had not yet arrived at the hospital, to inform him.
Instead the nurse acted like this was a typical pregnancy. Critical time passed until she even began checking the fetal heart rate. Once she at last did understand that the unborn baby was experiencing fetal distress. Now the nurse did tell the obstetrician, who even now was not in the hospital, by telephone. A different doctor on the unit took charge and performed an emergency C-section. The extreme pain had been due to a placental abruption. The placental abruption cased the unborn child to suffer from a restricted supply of oxygen causing significant brain injury. The newborn will be permanently disabled and has to have full time care. The law firm that handled this lawsuit reported that they were able to achieve a $4.5 Million settlement $4,500,000 from the hospital for the nursing not recognizing that the pregnant woman had experienced a placental abruption.
In this lawsuit the patient in fact alerted the nurse of her perception that something had gone wrong with the pregnancy. At this point in the pregnancy major continual abdominal pain can be caused by a placental abruption. It is not clear why the nurse did not connect these. Regardless if she disregarded the patients complaints, failed to hear them, did not have the appropriate knowledge, training or experience to correctly interpret the situation, or discounted the patients complaints since a placental abruption is generally (though not always) associated with observable vaginal bleeding, she overlooked signs of a dangerous complication.
The result, unfortunately, was a serious injury to the unborn child producing a permanent disability. Owing to the injury caused by the nurses error the law firm that represented the family reported that it was able to obtain a settlement intented to ensure that the child has proper care for life.
