It's the holiday season, and after taking a few days away with my family camping (which was lovely) it suddenly dawned on me that with a 2 year old in tow I wasn't going to be sleeping until 10am or relaxing by the campfire for too long! In fact, it's hardly a relaxing time for the adults when you are constantly running around after the little ones, no matter what type of holiday you choose. However, there are quite a lot of ways...more
The Direct marketing Association (DMA) has issued a new Code, its fourth, current from 1 September 2010. The previous one ran for seven years and many in email marketing felt it was long overdue. The good news for those with customers under the age of 18 on their email lists is that it clears up some of the anomalies in the previous codes. However, it has to be said, by no means all. It even generates one conundrum with regards to definitions. 'Children' is defined early on in the Code as 'those aged 18 years and under' whilst later they become 'those under 18 years of age'. The assumption is that the latter is correct but it could do with clarification. They are rather tentative with 'young person' defining one as 'those of 16 and 17 years unless otherwise specified'. One bit of good news is that 'minors' is no longer included. Those of us using the internet to populate our emails lists for email marketing will be pleased to find that the playing field has been levelled a bit and there is no distinction between the collection of data online and offline. The new rule is clear: no data is to be collected from children under the age of twelve without the ‘secure,...more

CARE AND PROTECTION OF VIVIAN.SUPREME JUDICIAL COURT OF MASSACHUSETTSMay 1, 1995, Argued July 26, 1995, DecidedIn January, 1994, apparently in response to the father's petition to modify the custody order, a judge of a Utah court awarded temporary custody of Vivian to her father. On February 3, 1994, after consultation with the Utah judge, a judge in the Plymouth County Probate and Family Court dismissed the mother's complaint for modification of the Utah divorce decree on the ground that the PKPA required the judge to defer to the Utah court's jurisdiction. In response to a report by Vivian's psychotherapist that Vivian's father had touched her inappropriately. The Department of Social Services (department) filed a petition for the care and protection of Vivian in the Wareham District Court. A judge awarded temporary custody of Vivian to the department. Subsequently, the judge denied the father's motion to dismiss the care and protection proceeding. In June, 1994, the department declined to permit Vivian to travel to Utah in connection with the custody contest pending there. On June 14, 1994, the father filed his complaint in this proceeding seeking an...more
