Mother Sues Paramedics Whose Actions Led To Death Of Her Baby
Many times, paramedics are the first to respond to medical emergencies. Paramedics are licensed health care providers who owe a duty to meet the standard of care to those they respond to and treat. As the first on the scene we expect paramedics to have the knowledge, training, and experience to differentiate between problems are capable of being treated at the scene from the ones that need urgent transport to a hospital with the proper equipment and full medical staff. This article examines a claim regarding a pregnant woman who called in from her home in the very early morning complications from her pregnancy. When the paramedics arrived at the house the woman was already in shock from abrupt loss of blood resulting from by a placental abruption. The paramedics failed to realize the seriousness of the circumstance and took approximately eighteen minutes prior to taking her to the hospital.
The full delay in the time it took the paramedics prior to making the call to take the woman to the hospital where the newborn was delivered was at least eighteen minutes. In the eighteen minute period the woman's unborn baby experienced hypoxia (the loss of necessary oxygen due to the placental abruption).. The child died the day after being delivered. The mother required further surgery for the severe bleeding . The bleeding was so major that she temporarily lost kidney function. The law firm that handled the case named the paramedics in the lawsuit.
Each State has its own unique laws for medical malpractice and wrongful death cases. A number of States have laws which enable only the mother to pursue a claim for the loss of newborn by reason of malpractice. The State in which this case arose, for example, mandated that in order for a mother to succeed on a claim for the emotional harm she endured from the death of her baby she first has to establish that she suffered a physical injury that was due to the same negligence that caused the death of the baby and that the mother's physical injury would not have typically occurred in a normal childbirth. Within 6 moths of the loss of her baby's death the mother fell into a deep depression. Despite a treatment regimen consisting of therapy and medication, the woman was still combating the depression at the time of the law firm's report. She will likely need to remain on medication for life. The mother met every condition. All 3 requisites were fulfilled in this case. Given the injuries the woman herself suffered due to the delay by the paramedics, she was able to go forward with a case.
The law firm that handled the case on her behalf reported that they took the case to trial and achieved a verdict of $4.5 million. As this case illustrates, health care providers such as paramedics are held accountable for giving care that is in keeping with the applicable standard of care. When they do not meet the standard of care they may be liable for malpractice.
