When you think of family law you think of wills
, custody, divorce, and perhaps even DUI charges. Law has so many facets and you want to hire the right lawyer for your families needs. Say you decide that it's time to create a will. It is a good idea for anyone, but particularly for someone with a family.
With a will you would be able to choose a guardian for your children. You could set up a trust for them and direct people as to how you want your assets handled. Examples include your home, vehicles, any savings and heirlooms you might like to pass along. For this purpose you would choose an executor. Being the executor is a big job. You can refuse the job. If you do not want the responsibility a declination must be filed. It is a good idea to ask the person you want to name before you do it.
You can write up an advanced medical directive as well. These would be used if your heart stopped or you stopped breathing. If you were in a coma this would spell out the way you would expect to be treated and would make clear to the doctor what your opinions would be. Otherwise, the hospital would do as family wishes or anything in their power to keep you alive.
After you write a will your circumstance may change. You could get divorced and remarried and have another baby. In this case, your wishes are going to be very different as well as your families' needs. It would be a shame if your ex -wife got the insurance policy that your new young family needed. Your assets may change, or even if you moved to a new state. In fact, some find that the laws change and a change to the will is a good idea. A family law attorney can make sure your family is protected.
Some rules to follow when writing a will are really quite simple and frankly common sense. It is not necessary to notarize your will, but in most states it's in your best interest so that no one can claim it is invalid. An executor must be named. You must be of sound judgment, and you must be at least eighteen years of age. Finally, it must clearly state that it is your will. Considering the rules it is important to remember that you do not need the help of family law attorney, however, knowledge of laws in your state can be helpful.
