The need for regulation

When sunbeds were not regulated many people (even young teenagers) were exposed to high amounts of harmful UV radiation. Increased exposure to UV radiation is known to increase the risk of a various skin conditions, including melanoma (skin cancer); the cost of lack of regulation has been high and decades later there is an increase in these skin conditions.

Regulation of sunbeds was slow to happen and during the first ten years of enthusiastic use', there was no regulation. The World Health Organisation has now warned that sunbeds are as dangerous as cigarettes and asbestos, which is to say very, very dangerous. As with cigarettes and asbestos, the effects may not be seen for many years.

Regulation of sunbeds is cost effective as the cost is less than the cost to the NHS of treating skin cancers and other skin damage caused by excessive exposure to UV light.

Intense Pulsed Light (IPL) and laser light treatments were regulated because it is known that they are potentially hazardous to the person being treated .

Why deregulate.

We have regulation to protect the public and because it is cost effective. Some services and products are being deregulated, not always because regulation is no longer needed, but sometimes to save money.

Cost considerations have to be taken into account in deciding when to de-regulate. This potentially dangerous equipment did not produce any VAT revenue when used solely by trained healthcare professionals.

Laser and light (IPL) treatments have been regulated by government because it was recognised that they are potentially hazardous devices requiring properly trained operatives.

In October 2010 the UK the Government implemented deregulation of laser equipment which allowed VAT to be charged if the operators were not healthcare professionals'. It allows VAT revenue to be collected on IPL growth areas, typically body hair removal, tattoo removal, skin photo-rejuvenation, rosacea treatment and reducing the appearance of facial and other skin blemishes.

The non profit making British Association of Aesthetic Plastic Surgeons has strongly denounced the deregulation by the Department of Health (DOH), of IPL and Laser treatments when used for non medical (aesthetic) purposes.

IPL can be dangerous with an inexperienced operator

A thirty eight year old lady was having hair removal treatment using IPL; the person operating the equipment was not regulated. The lady having hair removal mentioned she also had stretch marks. |The inexperienced person in the beauty salon said IPL could remove these. After treatment the lady had to go to A & E where she was told that she had 3rd degree burns.

A regulated clinician specialising in IPL treatment would have known that the settings for reducing skin blemishes and hair removal are not the same. It takes years of experience to know the best settings for each individual patient.
