The need for screening even asymptomatic people for colon cancer when they are fifty or older and for testing patients who exhibit certain symptoms like blood in the stool is commonly recognized within the medical community. Not doing so may lead to a delay in finding of colon cancer which in turn might give the cancer time to spread. Below we examine a case regarding a woman over the age of 50 whose doctors not only failed to screen her at the point she was asymptomatic but continued to not test her when she started having significant symptoms.

Consider a lawsuit that arose from the following situation: a female treated with a primary care physician from when she was 50 years old to the time she was 55. In that period of time her doctor saw her for obesity, a hernia and hypertension. Her doctor though never performed or recommended that she undergo screening for colon cancer.

She started having various symptoms vomiting and bloody stool diarrhea when she turned fifty five. At the emergency room the attending doctor diagnosed her as having gastroenteritis. She followed up with her physician a few days later who recorded a note of the fact that she now had up to three bowel movements per day all of which contained a blood. This physician recommended a wait-and-see approach and felt that she would need a lower G.I. endoscopy if her condition did not improve. The doctor's differential diagnosis was for colitis. The doctor apparently never considered cancer as part of the differential diagnoses. A year later she once more saw this doctor and reported having abdominal issues and as much as sixty pounds of unexplained weight loss. The physician concluded that her weight-loss was the consequence of a modification in her diet and even though she had a history of blood in her stools that physician once more failed to do any tests to eliminate colon cancer as the cause.

A month afterward she again ended up at the hospital with complaints of pain in her abdomen and ongoing diarrhea and she was seeing blood when she vomited. Her stool was now a dark brown color and testing revealed blood present in the stool. The physician at the emergency room diagnosed her as having a gastrointestinal bleeding. The physician from the emergency room had her get an x-ray which found a partial blockage of the bowel. Following this finding the doctor admitted her to the hospital. Additional testing followed. Blood tests then disclosed that her CEA, a marker for colon cancer, was abnormally high.

At first a gastroenterologist performed an upper G.I. endoscopy and obtained several biopsies. This gastroenterologist also failed to perform a colonoscopy. It was not until a covering doctor at the hospital recognized that her history was suspicious of cancer and that additional testing was required that a sigmoidoscopy was ultimately performed approximately two weeks later. The sigmoidoscopy showed a large blockage and a follow-up CAT scan revealed a large tumor. During surgery it was found that her cancer had already spread to both her uterus and to her bladder. Moreover the pathology report found the presence of cancer in more than ten lymph nodes. The diagnosis - stage IV colon cancer.

She started treatment consisting of but after suffering from intolerance for the chemotherapy as well as bowel obstructions and even renal failure, the woman died less than a year later. She was merely fifty eight years old. She was married and had two children both of whom were adults. Her husband and children pursued a claim against the doctors for the delay in the detection of the cancer. The law firm that handled this matter published that they were able to obtain a settlement in the matter for just under one million dollars for the family.
