Make An Argument That Puts The Family Court Judge On Trial
The family court ignores the constitutional due process required when ruling on a litigant's fundamental rights
. But that's what it does all day long. It's not just unfair to fathers, but geared to making your children effectively fatherless and you into a slave. The family court's process is stacked against you. So, you need to argue your case in a way that puts the judge on trial.
*Seeing through the propaganda:
Fathers face virtually a war against them when they go to family court under a divorce or paternity suit. They can expect to lose their children and most all their possessions. And then, they are turned into slaves to pay for up to 23 years for the privilege of being so unjustly deprived of their rights. That's what happens in war and in the family court.
Everything you hold dear and you know in your heart to be your rights are not only in jeopardy, but slated to be taken from you in the Family Court - if you are a father. The court propaganda and your lawyer will deflect your realization of this and simply stress your obligations to pay what you're told to pay and not to argue about what your rights are.
The fact is that there is no default for shared physical custody in most states. And shared legal custody rights as they pertain to the noncustodial parent are virtually ignored by the custodial mother AND the court. To the extent there is such a default, it's easily defeated by any abuse allegation by the mother. Neither mothers nor the rest of the Divorce and Domestic Violence Industry will allow this system to change without force. Their power is enormous and growing.
*Why the family court gets away with depriving you of your children and your rights:
The family court is able to control family court outcomes because it's characterized by
- no constitutional due process, no jury trial and no accountability of judges
- abuse complaints with no constitutional protection for fathers to justly defeat their malicious effects
- no assured equal custody - both physical and legal - for fit parents
- enormous child extortion payments to severely debilitate if not destroy fathers and for fees, and state incentives, and
- ever-growing fees and benefits to all the parasites that make up the divorce and domestic violence industry - all court-affiliated personnel - lawyer, judges, GALs, Probation Officers, psychologists, parenting and anger management courses, the huge child support enforcement industry,etc. - all of whom survive and prosper by denying fathers their rights.
And this is not going to change since it benefits the divorce and domestic violence industry, women as a class, and of course the feminist agenda of denying rights to fathers.
*Your best approach when you fight in court for your rights and your children:
Don't be deflected to what you're really up against; and don't let them pull the wool over your eyes. Speak up for yourself. Say what your rights are and that you've done nothing to be denied them - nor your children to be denied you as their parenting father. Speak up for yourself and your children at the same time.
When you go to trial, make your argument - your case - clear, cogent and legal so you can protect yourself better. Find the facts that support your rights and undermine those of the mother if she will not agree to fully share - or alternate - full custody (legal and physical) with you.
Show the facts of how she undermines your relationship with your children. Don't pull any punches when it's clear she intends to deprive you of full participation as a parent. Show that she is not a credible witness against you.
Show how the bests interest of the children are supported by you who will share custody of the children and their time with the mother - even if you were awarded full and sole custody.
*Making consequences for judges who produce clearly biased and discriminatory judgments:
Since a family court trial is a bench trial with no jury, the judge is required to make Finding of Fact to support his Judgment.
Your strong proofs and arguments and the recording of your trial can offset his contrived Findings and Judgment for his Judgment in your Appeal to your state's Appeals Courts. Judges don't like their judgments overruled by the Appeals courts. It makes them look incompetent and undermines future promotions.
When you make your case correctly and powerfully - covering all bases in your favor and against the mother's selfish behavior - you worry the judge. In consequence, he may rule more in your favour in judgment.
Or if the judge is sufficiently arrogant to unjustly rule against you and override the real facts of the case, your strong arguments will create your opportunity for finding redress of his bad judgment under an appeal.
In family court you are fighting in an undeclared war against you - a war on fatherhood and freedom. Don't be duped into thinking a just and fair judge is there to protect your rights and your children.
