Every year numbers of tragic incidents take place where the pronouncement of talaq (Islamic divorce) three times in single instances is held to have dissolved the marriage.
It is argued that such a practice are contrary to the teaching of the Quran and to accept otherwise is lack of knowledge and the consequences of which are far reaching such that not only the marriage ends but places the welfare of the children at risk as well.
The Qur'an is quite clear about the timing of pronouncement of talaq and most of all at (Surat An-Nisa) 4:35 it requires that the each party appoint an arbitrator to settle the differences between the parties and reconciliation is further supported by (Surat Al-Talaq) 65:2
In other words the husband and wife resolve their differences peacefully and in the event they are unable to do so to appoint arbitrators. So it is imperative that every effort is made by the husband and wife first and if necessary appoint arbitrator to reconcile.
If the views held that the marriage is dissolved by pronouncing of talaq three times in a single instance was correct then it begs to be questioned when and how can you appoint arbitrators after the event and what would be their function as there was no room left for retraction or reconciliation and is not in compliance with the above.
The Qur'an is the word of God and to believe otherwise would be contrary and it is Islamic Scholars who need to impress on the masses what is right and wrong and you can read more here.
The Shari'a law as to the talaq as expounded in the Qur'an is:
i. God does not favour divorces and in fact encourages the continuation of marriage and for the parties to settle their differences.
ii. If they can not they must appoint two arbitrators one from the husband's relatives, and one from the wife's relatives, to settle their differences
iii. And as a last resort the divorce is pronounced so that there is a month between each divorce thus allowing a period of three months for reconciliation and revocation of the divorce unless the divorce for the third time has been pronounced.
