An important ingredient in this mechanism running smoothly is the fair and just application of state and local laws.

With Chief Kenton Rainey at the helm, the public and BART police appear to be in good hands. Five months into the job, after a robust and exhaustive screening process, this resolute Chief has hit the ground running rebuilding his embattled department. He knows that the public won't stand for another Oscar Grant type shooting. He laments, "The entire situation has been devastating and has given the agency a black eye." So, his goal is to implement as quickly as reasonable the Board approved C.O.P.P.S. (Community Oriented Policing & Problem Solving) program.

The essence of COPPS concedes that traditional law enforcement techniques have had a marginal effect on controlling crime. So, a new approach (that might not be so new) that deals with the cause of crime while encouraging community participation and a more efficient use of existing resources will hopefully have a positive impact on the suppression of crime.

The Chief has a tall order to fill. Since the early 1970s law enforcement agencies have developed new strategies to reduce crime with questionable results. This Chief, however, comes with a pedigree of successes in crime reduction. The last three agencies he worked all witnessed a marked decline in crime. He states, "A professional law enforcement agency is measured by the absence of crime and social disorder in the community that it serves." Not a bad philosophy when it comes to crime fighting. The problem has always been in linking philosophy with reality.

Raised in Chicago public housing, Chief Rainey suffers no illusions about the enormity of his job. The road he is traveling is littered with the crushed hopes of Chiefs that preceded him. A back to the basics common-sense approach, something he attributes to his strong moral upbringing, is what the doctor ordered. He believes the problem and the solution are to be found in the community. Participation and citizen compliance is essential. He underscores this by stating, "It's not how many people you arrest, it's who you arrest."

Well aware of the issues raised regarding officer training, or lack thereof, Chief Rainey states that P.O.S.T. (Peace Officer Standard and Training), the state's certifying body, requires 24 hrs. of biennial training on Perishable Skills--such as, defensive tactics and the use of lethal and non-lethal force. The aim is to enhance the officer's ability to correctly respond to emergency situations in the street. In fact, he states that BART mandates each officer to receive 40hrs. of training annually, "Well above and beyond State requirements."
