Denver Teen Charged As Adult In Vehicuar Homicide - Denver, Colorado

The Denver Post is reporting on its website that the Denver County Office of the District Attorney is charging a 17 year old juvenile as an adult in the deaths of Jonathan Cisernos, 18, and his brother Martin Cisernos, 20. The charged juvenile, Mario Nava-Briones, faces two counts of vehicular homicide. The brothers were passengers in a car allegedly driven by Nava-Briones at the time of a crash in Denver, Colorado on July 26th of this year. The Denver Post article does not say if Nava-Briones is charged with class 3 or class 4 felony vehicular homicide charges.

Under Colorado law, vehicular homicide may be charged in two different ways. First, a person who drives a motor vehicle e while under the influence of alcohol, drugs or both, and causes the death of another person, is guilty of a class 3 felony of vehicular homicide. The potential sentence for this type of vehicular homicide in Denver is 4-12 years in the Colorado Department of Corrections. Second, a person who drives a motor vehicle in a reckless manner and causes the death of another person, is guilty of a class 4 felony of vehicular homicide. The possible sentence for this type of vehicular homicide charge in Denver is 2-6 years in the Colorado Department of Corrections.
