What To Do If You Are Injured At Your Workplace

Accidents often occur in the work place and in fact nearly half of all reported accidents are said to have happened in the work place.

Often people are anxious about claiming against their employers for personal injury although in reality they should not be. Although the situation may feel uneasy it should not be , all employers have a duty of care towards employees and it is a legal requirement that they have insurance in case an accident should happen. There are also laws in place to protect the employee if they do put in a claim so that no bad treatment can occur.

If you are injured in a work place accident and therefore you need to take time off to recover then you will, by law, be entitled to up to 28 weeks of standard sick pay. If after then 28 weeks you are still unable to return to work then you may be eligible for other benefits such as disability allowance. It is a good idea to research and fully understand what you are entitled to. It is also worth reading your work contract in order to check that there aren't any other sums contractually owed to you by your employer.

No claim for personal injury is exactly the same and some cases can be settled easily and within a matter of weeks whereas others require more information to be gathered or witness statements to be taken and therefore take longer. Many work place personal injury cases can be settled without having to go to court.

You must start proceedings within three years of the incident if you wish to claim for a work place personal injury incident. Your solicitor will be able to work to the strict time limits imposed by the court.

It is essential to always make sure your accident goes down in the company accident book as having an accident book is a legal record all employers must obey.
