What Are Public Liability Claims?

A lot of times accidents happen because someone experiences a momentary loss of attention

. Then, as a result of their own negligence, they get injured.

However, accidents that are not the fault of the injured person also happen in public areas. And when they do, other people may be responsible.

These types of accidents are caused by another person's negligence or carelessness. Some of these accidents can cause more long-lasting detrimental effects.

The party responsible for these types of accidents could be a business such as a restaurant or a supermarket, or perhaps a public authority.

If you have received an injury because of some other party's negligence, and if it happened in a public place, then you could have valid grounds to initiate a "public liability" compensation claim.

If you do, you may be able to recover the costs of your injuries. That's because the organizations that are responsible for the area where you were injured have a legal obligation to the public to properly take care of that property.

If they do not satisfy this responsibility then they are liable to compensate people for any injuries that resulted from their carelessness or negligence.

It is also their responsibility to have the proper public liability insurance. Presuming that they do, any personal injury compensation settlement will be paid by their insurance company.

For the most part, accidents that can result in public liability claims will fall into one of the following categories.

1. Public footpaths and pavements that are in disrepair or that are left untreated during snow and ice storms.

2. Injuries that are caused by falling down or tripping on stairways which need to be repaired.

3. Injuries caused by potholes.

4. Injuries in shops, restaurants, supermarkets, banks, movie theaters, etc. For example, if something has been spilled on the floor of a supermarket and if it is not immediately cleared there should be a clear warning that notifies shoppers of the potential hazard.

5. Injuries that result from objects that fall from scaffolding, roofs, or other heights in a public area.

6. Injuries that result from poorly maintained or broken railings, fences or pavements. Although local authorities are usually responsible for these accidents private landowners may also be liable if it is due to the poor state of their properties.

If you or someone you love has been injured in a public place then you should report the incident to the organization that is responsible. And, in order to receive compensation for their negligence via a personal injury settlement you should speak with a personal injury lawyer as soon as possible.
