I'm sure that almost all of us have been injured at some point in our lives. So what exactly constitutes a viable injury claim? In general, whenever someone is injured through the fault of someone else, you have the potential for a personal injury case. There are three main aspects to these lawsuits.
1) Negligence: In order for you to have a claim, someone else must be at fault for the accident. This can happen in one of two ways; either that person did something wrong, or didn't so something they should have. An example of negligence would be if someone hit a pedestrian because they were texting while they were driving. Obviously the act of texting is distracting, and a cause of negligence in this case.
2) Damages: You must lose something as a result of the accident. Damages can come in all kinds of forms, but are usually related to physical injury, property damage, and pain and suffering. For example, if you are hit by a car and have a wealth of medical bills pile up as a result, then damages would have to be recovered so the person at fault pays the bills.
3) Causation: In a personal injury case, there has to be a link between the negligence and the damages. The negligence had to have caused the damage, and oftenttimes this is the most difficult and time consuming part of a case.
