subject: Debt Collector Harassment At Work Place [print this page]

Debt collection practices in America are no longer easy on consumers who suffer for no wrong doing of theirs. Even when you owe a debt you have rights under the Fair Debt Collection practices Act (FDCPA). This federal statute was constituted and enforced by the Fair Trade Commission (FTC) to ensure fair debt collection practices.

One of the violations of the FDCPA that debt collectors commit while attempting to collect payments from you is calling at your workplace. Calls at work are prohibited by the FDCPA. Section 805(a)(3) of the FDCPA states that debt collectors may not call you at work if they know your employer forbids such communication (for example if you or your employer verbally informed them). By continuing to contact consumers at work under these circumstances, debt collectors may put them in jeopardy of losing their jobs. In 2009, 13.6% of FDCPA complaints, or 11,973 complaints, were related to calls to consumers at work. This is an increase from 10.3% of FDCPA complaints, or 8,103 complaints, in 2008. (Source: Page 9, Annual Report 2010: Fair Debt Collection Practices Act).

Calling at work place often puts you in a difficult position with your superiors as well as other employees who may attend to debt collectors' calls. The FDCPA has clear guidelines about this. A debt collector may not call you at unusual or inconvenient places. In such a scenario, calls at work place are bound to be not only inconvenient but create disturbance in your work life.

You have a right to sue these debt collectors who call at your workplace and attempt to collect payment on debts. You may engage an FDCPA attorney who can represent you. You may contact attorney Brian Parker at collectionfighter.com for a free representation of your case. Attorney Brian Parker has tried and won more cases for consumers than any attorney currently practicing in the FDCPA area.
