subject: Child Custody And Who It Effects [print this page] Child custody has always been a delicate issue. There are support groups, and free aid from most states to assist people in this position. Sadly, however, much of the help does not deal with the real reality of the domestic court system and what you will cope with with child custody problems.
It's important for people to know their custody rights when they become involved in a custody situation. What are the rules that govern the custody rights? How can people make sure they are being treated fair?
Many protective mothers are being charged with alienating their children from their father, creating false allegations, or being uncooperative with visitation and access to the child. While there are certainly legitimate cases of these things happening, it's not nearly as much as the courts have started to believe.
There is the added complication of the changes in family law. With the advances made in fathers rights over the years, many abusive fathers are benefiting from the increasingly common ruling of joint custody, or even physical custody being awarded to the father.
There are also many people who are dealing with abusive circumstances without any records of abuse - no law enforcement reports, protective orders, injury records, etc. Their single evidence is their word versus their abusers.
Numerous times the abuse is undetectable which, while definitely as detrimental, leaves no material traces. For these people there is simply a hole in the judicial system, a void in the means available, and the options available to them.
