If you exceed this number of days, you will be a resident and you will be required to pay taxes. Again, the maximum average number of days that you should spend in the United Kingdom over a period of four tax years should not in any way exceed 91 days. This means that you should not spend a total of more than 364 days in a four tax year period and not more than 183 days in any given tax year.

Once you have determined that you are leaving the UK and that you will no longer be resident, you can then fill the form p85 which will help you in determining whether you are due for tax refund. The main source of your tax rebate (if any) will come from the fact that the government usually allows the tax payers a tax-free allowance. It is from the unutilized tax free allowance of the year where you are now able to get your tax rebate.
