COLLABORATIVE LAW CHILD CUSTODY

One of the biggest concerns and hotly contested issues in Virginia divorce is what to do with the children. Typically, parties have very strong views on how their children should be raised, with whom they should reside, when and how the children will spend time with the other parent, and how the children will be supported.

When participating in Virginia collaborative divorce, the parties have the benefit, should they so choose, of using a collaborative child specialist. The collaborative child specialist is in a unique position to help the parties work together to provide for their children while considering the individual personality, wants and needs of each child. While each parent believes that he or she knows best when it comes to the children, in actuality, each parent's view of the children is colored by their experiences in the marriage, the separation, the divorce process, and by their own personalities. The child specialist helps the parties to focus their attention on the child's needs, not their own. The child specialist is used as needed by the parties and is often utilized in creating a parenting plan. Further, as an added benefit, the child specialist is able to assist the parents with the skills and tools necessary to help their children cope with the stress of divorce.

Depending upon the county in which the divorce is litigated in Virginia, the court may require a separate custody trial. This means that the parties are paying their attorneys for their preparation and appearance at two trials (custody and equitable distribution). Further, the Judge, who is not a child specialist and who is a stranger to your child is making important decisions that will affect your child's life and development. Alternatively, in the Virginia collaborative divorce process, the parents who are the experts when it comes to the child, are making the decisions armed with the information, skills and tools provided to them by the child specialist.
