. Workers are required to work at heights and they deal with heavy, sharp and large equipments. So accidents are very common in these places. But under the New York state labour laws, there are certain rights for these construction workers to seek compensation for their injuries. New York state labour laws allow construction worker to bring a 3rd party action against the individual or person who owns the property or control the work.
This law applies not only to actual construction work, but also to erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure.
You must ensure the followings to protect your rights:
1.Know your employer: Make a note of the name and address of your employer and the foreman as you may be working for different employers on different days.
2.Know the general contractor: If anything wrong happens with you and your employer fails to compensate for those events then the general contractor is liable to compensate, as it is his/ her responsibility to provide safety measures. So, make a note of the general contractors name and address too.
3.Know your co-workers: Co-workers are always helpful as they are generally the eye witnesses of accidents that take place at construction sites. Get the full details of your co-workers as you may need them as witnesses in the legal proceedings.
4.Report all incidents and injuries immediately: Even the small injuries should also be reported to your foreman immediately after the incident.
5.Notify your union if injured: If you get injured it is your first duty to inform your union about the incident, so that in future they can assist you in claims.
